Please read these Terms and Conditions carefully before accessing or using the website and services provided by Vision Mycology LLC (“Vision Mycology,” “Company,” “we,” “us,” or “our”). By accessing or using VisionMycology.com or purchasing products, you agree to be bound by these Terms.
Shipping policy
Orders are typically processed and shipped within five to nine business days after payment is received. Processing may be extended during holidays, severe weather, or high order volume. Carrier estimates are not guaranteed. Customers must provide an accurate address. Contact VisionMycology@gmail.com within seven days of recorded delivery regarding a lost, damaged, or mishandled order.
1. Ordering restrictions and legal compliance
Age requirement
All customers must be at least twenty-one years old at the time of purchase. Vision Mycology may request proof of age and may cancel orders if age cannot be satisfactorily confirmed.
Research and microscopy use only
Restricted genetics are sold strictly for legal microscopy and research purposes only. You are responsible for compliance with all federal, state, and local laws, will not use products unlawfully, and assume responsibility for misuse. Vision Mycology is not liable for claims, consequences, damages, or injuries resulting from improper or illegal use, including unlawful cultivation.
2. Interpretation and definitions
Capitalized words have meanings defined in these Terms in singular and plural. “Company” means Vision Mycology LLC; “Service” means the website and products or services provided; “Terms” means this agreement; “Third-Party Services” means services or content supplied by others; “Website” means VisionMycology.com; and “You” means the person or entity using the Service.
3. Acknowledgment
These Terms govern your use of the Service. By using it, you acknowledge that you have read and understood the Terms, agree to be bound by them, and are at least 21. Individuals under 21 may not use the Service or purchase products.
4. Third-party websites
The Service may link to sites not owned or controlled by Vision Mycology. We are not responsible for their content, privacy practices, terms, or losses arising from reliance on them.
5. Termination
Vision Mycology may suspend or terminate access without notice when these Terms are violated or unlawful or inappropriate conduct occurs.
6. Limitation of liability
To the fullest extent permitted by law, Vision Mycology and its affiliates, employees, suppliers, and partners are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profit or data, business interruption, personal injury, or legal consequences arising from misuse. Total liability will not exceed the amount paid for the relevant product or service, or $100 USD if no purchase was made. Some jurisdictions do not allow certain limitations.
7. “As is” and “as available”
The Service and products are provided without express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, or error-free operation. Where exclusions are not permitted, disclaimers apply to the maximum lawful extent.
8. Governing law
These Terms are governed by the laws of the United States and the State of Colorado without regard to conflict-of-law principles.
9. Dispute resolution
Before formal action, contact VisionMycology@gmail.com and make a good-faith attempt to resolve the matter informally.
10. Severability and waiver
If a provision is invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
11. Changes
Vision Mycology may modify these Terms. Material changes will be posted with an updated effective date. Continued use after changes constitutes acceptance.
